- The Governor can recommend the imposition of President’s Rule in the state if the governance of the state cannot be carried out according to the provisions of the Constitution.
Functions as Administrator of an Adjoining Union Territory:
- If a Governor holds additional charge of an adjoining union territory, they may exercise their functions as an administrator with discretion.
Determination of Royalty Payments:
- The Governor can determine the amount payable by the Government of Assam, Meghalaya, Tripura, and Mizoram to an autonomous Tribal District Council as royalty accruing from licenses for mineral exploration.
Seeking Information from the Chief Minister:
- The Governor can seek information from the Chief Minister regarding the administrative and legislative matters of the state.
Situational Discretion:
Appointment of Chief Minister:
- In situations where no party has a clear majority in the state legislative assembly, or if the Chief Minister in office suddenly passes away and there is no clear successor, the Governor may use their discretion to appoint a Chief Minister.
Dismissal of the Council of Ministers:
- If the council of ministers cannot prove its confidence in the state legislative assembly, the Governor may use their discretion to dismiss the council.
Dissolution of the State Legislative Assembly:
- When the council of ministers loses its majority, the Governor may use their discretion to dissolve the state legislative assembly if the situation warrants it.
