Approval and Duration of Financial Emergency

The process of declaring and approving a Financial Emergency in India is structured to ensure that the President has the authority to act swiftly in times of financial crisis, while also requiring the approval of the Parliament for the declaration to remain in effect.

Approval Process for Financial Emergency

  1. Declaration: The President can declare a Financial Emergency if he is satisfied that a situation has arisen due to which the financial stability or credit of India or any part of its territory is threatened.
  1. Parliamentary Approval: Once the President issues a proclamation of Financial Emergency, it must be approved by both the Houses of Parliament within two months from the date of its issue.
  1. Simple Majority: The resolution approving the proclamation of Financial Emergency can be passed by either House of Parliament only by a simple majority, which is a majority of the members present and voting.
  1. Indefinite Continuation: Once approved by both the Houses of Parliament, the Financial Emergency can continue indefinitely until it is revoked by the President. This means there is no specific time limit for the duration of the Financial Emergency, and no requirement for repeated parliamentary approval.

Revocation of Financial Emergency

  • Presidential Proclamation: The President may revoke the proclamation of Financial Emergency at any time by issuing a subsequent proclamation. This revocation does not require the approval of the Parliament.
In summary, while a Financial Emergency can be declared by the President, it must receive parliamentary approval within two months. Once approved, the Financial Emergency can continue indefinitely until the President decides to revoke it. The revocation can happen at any time at the discretion of the President without needing further approval from the Parliament.
