Supreme Court : Acting, Ad-Hoc and Retired Judges

Acting Chief Justice

The President can appoint a judge of the Supreme Court as an acting Chief Justice of India when:
1. the office of Chief Justice of India is vacant; or 2. the Chief Justice of India is temporarily absent; or 3. the Chief Justice of India is unable to perform the duties of his office.

Ad Hoc Judge

Retired Judge

  • Request for Service: The Chief Justice of India can ask a retired Supreme Court or High Court judge to act as a judge of the Supreme Court for a temporary period.
  • Consent and Approval: The request requires the retired judge's consent and the president's approval.
  • Allowances and Benefits: The retired judge receives allowances as determined by the president and enjoys the jurisdiction, powers, and privileges of a Supreme Court judge during their temporary service.
  • Not Deemed Supreme Court Judge: The retired judge serving temporarily is not considered a Supreme Court judge in any other context.
